| | | The US Patent and Trademark Office (UPSTO) has introduced a new green energy inventions category to its Patents for Humanity Program. The award will provide business incentives for patent applicants, holders, and licensees that develop innovations in wind, solar, hydrogen, hydropower, geothermal, and biofuels technologies that address the challenges of climate change. Winners of the award will receive a certificate to accelerate USPTO processing for a patent eligible subject matter application, and public recognition of their work. The acceleration certificate can also be used to obtain funds to help develop the invention into goods and services. The Patents for Humanity Award was recently codified into law with the Patents for Humanity Act of 2022. This is the USPTO’s top honor for patent applicants that devise innovations to address long-standing development challenges. The program provides initial feedback from the agency on patent applications, known as “first office action,” to individuals or small businesses that qualify as a “micro entity,” including those from underrepresented groups in the innovation industry. Wait times for patent applications can act as a barrier to commercialization, particularly for those in underserved economic areas, women, people of color, and veterans. The first-time filer initiative will accept up to 1,000 petitions for expedited examination, supplementing the USPTO’s other expedited examination programs, including those supporting COVID, cancer immunotherapy, and climate change mitigation.
