On August 29, 2018, the USPTO issued updates to its AIA Trial Practice Guide (AIA TPG).  The AIA TPG was first published in August 2012 and guides practitioners on procedures including inter partes reviews, post-grant reviews, derivation proceedings, etc. The update incorporates the Patent Trial and Appeal Board’s (“the Board”) current practices and provides further explanations to already-included practices. The update accounts for six years of the Board’s experience with the program. To learn more about the update and the AIA TPG, click here.

Prolonged Outage Sparks Concern About USPTO’s Aging Tech

In August, the U.S. Patent and Trademark Office’s (USPTO) online patent filing system was taken offline for repair due to a glitch. The system, which dates back to the 1980s, was not fully back online until August 22, leaving attorneys with no choice but to physically mail and fax patent documents. The issue comes only two and a half years after another lengthy system outage, creating concerns about the fragility of the aging information technology system and highlighting the need for improvements. Global NY

Is your NYS business thinking about exporting? If you’re already sending some of what you make overseas, would you like to expand that part of your operation? Many small-to-medium companies want to reach global markets, but they need to manage their risks. As the result of the National Export Initiative (NEXT) and Global NY initiative, the federal and state governments are willing to share this risk with you. Global NY can connect your company to the State Trade and Export Promotion (STEP) program. The STEP Program is offered by the U.S. Small Business Administration (SBA) through Empire State Development (ESD). To learn more about STEP and how it can help your business, click here. NYS STLC has also compiled an Export Control Guidebook to assist individuals considering the export of their technology.
